Plaintiffs accused BiTMEX for market manipulation strategy. Plaintiff submitted very lengthy documents which included all the allegations against BiTMEX.
BMA LLC — a company formerly known as “Bitcoin Manipulation Abatement” . This company is famous to bring complaints and points against crypto companies. Now this time BMA LLC and a group of crypto traders filed an amended bill against BiTMEX for their market manipulation.
Through the amended complaint, BMA LLC claimed that BiTMEX is involved in market manipulation, fraudulent inducement, and violated both the Racketeer Influenced and Corrupt Organization Act (RICO) and Commodity Exchange Acts. The complaint includes 378 pages long and features more than 1,000 paragraphs.
The district court judge claimed that all the allegations and accusations against BiTMEX are just copy paste of the filed complaint against BiTMEX in NewYork.
With the consideration of the length of the complaint, the court judge also claimed that these are not enough to prove any type of allegation and also that the previous complaint was too lengthy ( 237 page, 600 paragraph).
“I will not consider those copied allegations, for which the Messieh court will determine plausibility,” Judge Orrick said. “Plaintiffs’ other allegations are insufficient for the same reasons identified in my previous order.”
Finally, the District Court judge said that plaintiffs are not allowed to bring new complaints and copy paste of details are just violations of law360.
“Judge Orrick did not cite a single case to support his assertions regarding the copied material.”
